Right of withdrawal
Customers may revoke their declaration to conclude a sales contract within a period of two weeks in textual form (e.g. by letter, email, facsimile) without stating a reason or by returning the goods. The grace period for withdrawal begins earliest upon receipt of the goods and this notification by the recipient (in case of recurring deliveries of the same type of goods not before receiving the first partial delivery) and not before we have met our information duties and other duties as defined by 246 § 2 in conjunction with § 1 clause 1 and 2 EGBGB as well as our duties defined by § 312e clause 1 sentence 1 BGB in conjunction with 246 § 3 EGBGB. In order to meet the withdrawal deadline it is sufficient to dispatch the withdrawal or goods in time. Consequences of withdrawal
In case of an effective withdrawal both parties must return all received goods or services and refund benefits of usage (e.g. interest rates) if applicable. If the Customer cannot return the received services or goods to us, or if he can return the services or goods only in part or in deteriorated condition, the Customer may have to compensate us accordingly. This does not apply if such deterioration is entirely attributable to their inspection as it would have been possible for the Customer in, for instance, a retail store. The obligation to reimburse the seller for the value of the product can also be avoided by refraining from treating the relevant goods like his own property, and from refraining from any action that could be damaging to the overall value of the product. Items suitable for delivery by parcel are to be returned at our risk. The Customer has to pay the costs of the reshipment, if the delivered goods match with the ordered goods and if the price of the reshipped goods does not exceed an amount of 40,00 EUR or if the Customer at a higher price of the goods has not rendered the trade-off or the contractual agreed partial payment at the time of the withdrawal. Otherwise the return is free for the Customer. Goods that are not suitable for consignment by parcel post shall be collected. Obligations to refund payments must be met within 30 days. This period shall commence for the Customer upon dispatch of the goods or the request to take back the goods, and for us upon receipt.
